Buying a house
Whilst no two transactions will be the same as each property is different and potentially subject to different property rights, buying a house generally follows three stages.
Stage one
First of all, an offer for the property obviously has to be made, and you should bear the actual worth of the property with reference to prevailing market conditions. If your offer is accepted, we will contact the seller’s solicitors and ask them to send us a draft contract, and we will consult with you in negotiating this. In addition to the draft contract, we will also be sent a fixtures and fittings form and a property information form. We will then make pre-contractual enquires and for some properties it may be necessary to look at title deeds. However, with the introduction of compulsory land registration, this has become increasingly rare.
An important part of conveyancing are searches. Searches are conducted to find out more information about the property so you are in a better position to decide on whether to commit to the transaction or not. Types of searches include:

- Water and Drainage Searches
- Environmental Searches
- Possibly Mining Searches
- Posssibly Chancery Searches
The searches that we conduct we conduct depends on your attitude towards risk and, importantly, the searches that any mortgage lender involved in the purchase wish to undertake.
Finally, a completion date will need to be agreed on, that is the date on which the transaction will be legally complete and you will be entitled to take possession of the property.
Stage two
Once stage once, is complete, we will exchange contracts with the seller’s solicitors, send a transfer document and pay the deposit the seller has requested (usually 10%). If you cannot afford the 10%, this may be negotiable or we could even arrange for the buyer of your home to forward the deposit he is paying to you to the seller of the house you wish to buy, if you are buying and selling simultaneously. The other important part of this stage involves arranging the monies to be transferred and we will need to liaise with your mortgage company to make sure they are transferred in time for the completion date.
Stage three
The process is complete and you are given the keys for your new home!
