A different approach to resolving disputes
Where possible, the law does not like to interfere in family disputes and as such court should be thought of the last step. We understand family disputes can be emotionally stressful and even heart breaking which is why we emphasise a different approach to resolving disputes. Mediation is an informal means of settling disputes where both parties to the dispute negotiate through a mediator to reach a settlement. The settlement can have legal affect. If you are getting separated, for example, you can agree on a separation agreement, so you do not have to go to court to resolve issues related to finances, who will live in the matrimonial home and where the children will live.
Pre-nuptial agreements – can they be used in the UK
One in three marriages now end in divorce. This fact has been recognised as contributing towards the general population’s increasing anxiety with regards to marriage as marriage rates drop and the average marrying age increases. The powers that be have become aware of this, and slowly but surely pre-nuptial agreements are being accepted by the legal community as having legal force. Pre-nuptial agreements will be legally valid where both parties to it have sought legal advice, there has been full financial disclosure and circumstances have not changed drastically.
